GALVESTON, Texas (AP) — A 16-year-old girl tried in vain to stop her stepmother from repeatedly running over her father and killing him, according to a lawsuit filed in federal court.
``I saw my stepmother, Clara Harris, kill my father, David L. Harris, by hitting him with her Mercedes Benz,'' Lindsey Harris says in the lawsuit filed on her behalf by her mother, Debra Shank.
Shank, David Harris' ex-wife, said in the filing that her daughter tried to stop Clara Harris but ``was forced to witness the death of her father.''
Prosecutors say Clara Harris killed her husband of 10 years in a Houston-area hotel parking lot July 24 after confronting him and another woman at the hotel.
She is expected to plead innocent to charges that she hit her husband at least three times before parking the Mercedes atop his body. She is a dentist; he was an orthodontist.
The lawsuit asks a judge to bar Clara Harris from access to David Harris' estate. A hearing was scheduled for Friday.
The lawsuit was filed in federal court because Shank and her daughter live in Ohio.
Defense attorney Jimmy Walker did not return a message Thursday.
